RESOLUTION APPROVING THE MEDIATION SETTLEMENT AGREEMENT BETWEEN THE UNIVERSITY OF NORTH ALABAMA AND FLORENCE CITY SCHOOLS

WHEREAS, representatives from the University of North Alabama participated in court ordered mediation with representatives from the Florence City Schools on March 16 and 17, 2017, the purpose of which was to consider the impact of the proposed new Florence Middle School on Braly Municipal Stadium; and
WHEREAS, following extensive negotiations, these representatives from both parties agreed on the terms set forth in the proposed Mediation Settlement Agreement (hereafter "the Agreement") dated March 17, 2017; and
WHEREAS, throughout these deliberations, UNA officials have sought to focus attention on the University's interests relative to the Stadium Use Agreement and not on the broader question of the site selection process for the new Florence Middle School; and
WHEREAS, given the appropriate scope of UNA's interest as set forth above, the Board wishes to acknowledge community interest in this topic and to make clear that action on the Agreement does not constitute endorsement of the site selection process, that being solely the province and responsibility of the Florence City Board of Education; and
WHEREAS, both the President of the University and the Board affirm the importance of the relationship that exists between UNA and Florence City Schools, as well as the need for both entities to continue to work together for the benefit of all students; and
WHEREAS, the President has determined that the Agreement adequately addresses UNA's concerns regarding parking, pedestrian access, and select modifications to Braly Municipal Stadium; and
WHEREAS, the Agreement requires the approval of both the UNA Board of Trustees and the Florence City Schools Board of Education;
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees for the University of North Alabama that it does hereby approve the Mediation Settlement Agreement dated March 17, 2017.
BE IT FURTHER RESOLVED that the Board does hereby authorize the President of the University to take all necessary steps to comply with the Agreement and to work with officials from Florence City Schools to make the required changes to the Stadium Use Agreement.
